Terms and Conditions

By signing the booking form, you acknowledge that you have fully read and understood these terms and conditions.

Nelson Watersports Limited reserves the right to change the running of the course to suit the conditions or needs of the group. We will do our best to run the booked activity, but this may not always be possible.

Participating in watersports involves an element of risk. These risks include accident & injury, illness/death from drowning, exposure, and damage to equipment/personal property.

At Nelson Watersports Limited we will take all practicable measures to identify, and then eliminate/isolate/minimise these risks. However, your safety remains your sole responsibility. You must follow our instructions and wear safety equipment provided at all times. You indemnify Nelson Watersports Limited and Nelson Yacht Club Incorporated from any liability we may incur to another party due to your actions. You are responsible for taking out any insurance to protect yourself in this respect.

You/the participant must be confident in the water, and able to swim at least 50m in a buoyancy aid.

You must advise us on this booking form of any illness or medical disability that you/the participant suffer from. Whilst it may not necessarily prevent you/the participant from taking the course or from hiring equipment, Nelson Watersports Limited cannot accept any responsibility for any accident stemming directly or indirectly from a clients medical condition.

You agree that you/the participant are responsible for any loss, damage, injury (including death) or accident to yourself or others whilst on a course/lesson, renting equipment or visiting the site.

You agree that you/the participant are solely responsible for any damage to equipment, and that you shall pay for any repairs, and make up for any impact on the re-sale value.

WARNING: Under New Zealand law it is extremely unlikely that you will be able to sue anyone if you are injured. In addition, New Zealand’s accident compensation scheme (ACC) provides only limited assistance to visitors to New Zealand who are injured. We strongly recommend that all visitors to New Zealand have full insurance covering any injury they might suffer, including medical treatment cover before undertaking any activity.

Cancellation/postponement by Nelson Watersports:
Every attempt will be made to make sure that your course actually runs. However, Nelson Watersports Limited reserves the right to cancel a course at any time if viable numbers are not achieved or if weather conditions are not suitable. Where we have to cancel a course, another set of dates will be arranged as soon as possible, to mutual convenience.

Nelson Watersports Limited reserves the right to withdraw services or request a student to withdraw from a course if the safety of the instructor, student or others is in any doubt.

Cancellations by client:
If notice of cancellation is given less than one month before the start of the course, 100% of the course fee is retained.

Any course/hire booked is valid for a maximum of 12 months from date of booking. Courses/hire not taken within 12 months will be forfeited.

Course/hire bookings are transferable at the discretion of Nelson Watersports Limited. If a course is transferred 72 hours or less before the start of the course a $15 admin fee will be charged.
